Education of Homeless School-Age Children
All school-age children, including the homeless, who live within the Jackson County School District, shall be eligible to attend the district's schools. As used herein, the term 'Homeless' shall mean: a person who is (1) an individual who lacks a fixed, regular, and adequate nighttime residence and (2) an individual who has a primary nighttime residence that is -- (A) a supervised publicly or privately operated shelter designed to provide temporary living accommodations (including welfare hotels, congregate shelters, and transitional housing for the mentally ill); (B) an institution that provides a temporary residence for individuals intended to be institutionalized; or (C) a public or private place not designed for, or ordinarily used as, a regular sleeping accommodation for human beings.
The local school officials shall have the authority to place each homeless child or youth in the appropriate education setting by either:
1. Continuing the child's or youth's education in the school district of origin for the remainder of the school year or
2. Enrolling the child or youth in the school district where the child is actually living, whichever is in the child's best interest or the youth's best interest.
